The following terms and conditions and any other related rules that are adopted by Investex LLC and made available herein (collectively the “Conditions of Sale”) shall apply to all sales of Investex LLC products that you (the “Customer” or “you”) may order from Investex LLC, a company organised and existing in New Mexico (“Investex LLC” or referred to herein as “us”, “our” or “we”).
These Conditions of Sale apply exclusively to sales made through the Investex LLC website. Investex LLC may modify the Conditions of Sale from time to time, at its sole discretion.
The Conditions of Sale applicable to any order placed through the website are those in force at the time that you place your order. When you check the “I Accept” or similar box at the order confirmation section of the Website before placing your order, you indicate your acknowledgment and your full acceptance of these Conditions of Sale. If you refuse to accept these Conditions of Sale, you will not be able to order any Investex products from the website.
Persons wishing to use the Website will also be deemed, by virtue of such use, to have agreed to be bound by our Website Terms of Use and our Privacy Notice, which are incorporated to these Conditions of Sale by reference.
Only individuals who (a) have reached the age of majority (eighteen in most countries), and (b) have legal capacity to enter into contracts, may order products from Investex LLC. Any orders placed in contravention to this provision shall be null and void. By placing an order through the website, you represent and warrant that you are a bona fide end-user Customer and will not deliver, sell or otherwise distribute Investex products or purchase Investex products for commercial purposes or any other commercial benefit. If despite our efforts the product is no longer available or Investex LLC believes, for legitimate grounds, that an order would violate these Conditions of Sale, We may refuse such order.
All orders placed through the Website are subject to availability and acceptance by Investex.
Investex reserves the right to change the assortment of products and services offered on the website and may limit from time to time the quantity of products and services available or that may be ordered by a Customer in a single buying session.
The product pages of the website can provide you with information regarding products that are currently available for sale through our website. Please note that only those items displaying an “Order Now” button (or similar) are available for sale through the Website. You may also contact the Customer Support Centre (details indicated on the website) and an Investex representative will provide you with further information as to product availability and assist you with your purchase.
All prices shown on the product pages of the website exclude shipping costs and sales taxes unless otherwise stated. The applicable currency will be updated based on the shipping destination after you provide us with the delivery address in the case of any physical (non digital) products.
Investex reserves the right to modify prices and delivery costs at any time without prior notice. The price of a product and delivery costs displayed on the website, as indicated at the time Investex provides you with a Confirmation of Order, will be honoured by Us.
Shipping costs are not stated on the product pages but will be added to the product price after you have chosen your delivery options in the case of physical (non digital) products.
Shipping costs and applicable taxes will be reflected on your order page, that is to say the last page before you are asked to confirm and place your order and will also appear on your receipt. Shipping costs, if any, are described in the shipping policy set forth below.
Taxes applicable to the customers individual country of residence such as import duties are the responsibility of the customer, not Investex. The customer should check if they will be required to pay import tax or duty before ordering from Investex. In the event of a refund, Investex will not reimburse any import taxes paid to government agencies by the customer.
Payment by credit or debit card
You may pay by credit or debit card, as indicated on the website.
When ordering on the website, you will need to enter your payment details on the appropriate form. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Investex, you will need to contact your card issuer directly to solve this problem, and Investex will not be liable for any delay or non-delivery.
In order to process your order, we may perform a pre-authorisation of your card. By submitting an order for any Investex products or services on the website, you expressly authorise Investex via our payment gateway provider to perform such pre-authorisation and, where Investex deems necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your card number, to authenticate your identity, to validate your card, to obtain an initial card authorisation and to authorise individual purchase transactions.
Payment by bank wire transfer
You may also pay by bank wire transfer for purchases of products or services from our website, when agreed via email with one of our support representatives.
After you place an order via email or telephone, Investex will wait until your payment is received before processing your order. If the funds are not credited into our bank account within seven (7) working days after you have placed your order, this order will be cancelled.
Investex will not charge a fee for paying by bank wire transfer, but please ensure that we receive the full amount before we process your order. Please note that some financial institutions may charge you a fee for using a bank wire transfer.
Security
Investex takes precautions — including administrative, technical, and physical measures — to safeguard your personal information against loss, theft, and misuse, as well as against unauthorised access, disclosure, alteration, and destruction. Investex uses Secure Sockets Layer (SSL) encryption on all web pages where personal information is collected.
Although we will do our best to protect your personal Information throughout the online selling process, we cannot guarantee the security and integrity of the data you transmit to the website and cannot be held liable for any harm or loss resulting from the use of the internet network, such as in the case of hacking.
In order to secure your transaction and prevent fraud, Investex will perform a credit card and anti-fraud check. By placing your order, you will be deemed to have authorised Investex to perform such checks and, where Investex deems necessary, from time to time to transmit or obtain information that you have provided to Investex about you in order to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise a particular purchase transaction.
Upon successful payment for the product or service you have ordered, following completion by Investex of security checks, We will send you by e-mail a written Confirmation of Order (your receipt).
The Confirmation of Order constitutes the acceptance of your order by Investex LLC and indicates the existence of a binding sales contract.
In most instances, Investex products and services are delivered in digital (non physical) form, and thereby do not entail any shipping requirements. In the event a physical shipment is required, delivery costs will be assessed by Investex and will be added to the price of the Investex products themselves. Please refer to the product page for more information.
The delivery costs and the estimated delivery lead time will be mentioned on the website product page or by the Investex support representative before you place your order.
When estimating package delivery time, please allow time for credit approval, address verification and order processing, as well as receiving your payment in case of bank wire transfer. Once the order is processed and ready for shipment, we will send you the Confirmation of shipment by e-mail.
We will use reasonable efforts to ensure delivery by the carrier within the estimated delivery lead time from the date of our Confirmation of shipment.
Investex insures each purchase during the time it is in transit until it is delivered to you. We require a signature by an adult to confirm the delivery of each Investex product, at which point responsibility for your purchased goods passes to you.
Over and above New Mexico statutory law, Investex provide customers with the right to withdraw from any purchase contract within 30 days without giving any reason. The withdrawal period will expire after 30 days from the day on which you order Our products or services.
To exercise the right of withdrawal, you can contact our Customer Support Centre (details indicated on the website). You must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail), which we must receive before the withdrawal period expires.
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (in the case of physical goods) without undue delay and in any event not later than 30 days from the day on which we are informed about your decision to withdraw from this contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction.
We will not reimburse any additional import tax or duty you incurred that were paid to your country of residence government.
We will withhold reimbursement until we have received the goods returned back to us in the case physical products.
You shall send back physical goods to us without undue delay and in any event not later than 30 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 30 days has expired. You will have to bear all costs associated with shipping physical items back to us.
This “Right of Withdrawal” is the minimum term set out by Investex LLC in good faith to all its customers. However please note that we may extend your rights of withdrawal to longer periods for certain products and services on our website. Ensure you check the specific product or service page when you place your order to establish if you have a longer period in which to act.
After the right of withdrawal minimum term has expired, all sales are final and no refunds will be issued.
